Legal entities that want to obtain an electric vehicle charging network operator license will be able to make their license applications through the electronic application system of the Energy Market Regulatory Authority (EMRA) as of April 18 (today). According to the announcement on EMRA's website, applications for charging network operator licenses will only be received electronically, and license applications made by hand or by mail will not be taken into account.

EMRA has published the points to be considered about the applications for the Charging Network Operator License on its website. It is important to take steps under the following headings:

The legal entities that will apply for a license will have to submit the original or a notarized copy of the authorization documents of the person or persons they are authorized to apply to EMRA, in person or by mail, as an attachment to a letter prepared in the required petition format.

The "Charging Service Regulation" (Regulation), which determines the procedures and principles regarding the establishment of charging units and stations where electrical energy is supplied to electric vehicles, the operation of the charging network and charging stations connected to the charging network, and the "Procedure Regarding Applications for Charging Network Operator License Transactions" "Charging Network Operator License" (License) applications within the framework of "Procedures and Principles" (Procedures and Principles) have started to be received through our Institution's electronic application system as of 18.4.2022.

In this respect, legal entities that will apply for a license should examine the Regulations and Procedures and Principles in a comprehensive manner, and obtain information on all rights and obligations that will arise within the scope of the said legislation. However, it is important for those concerned to pay attention to the following points.

Before applying for a license, the interested parties should prepare a charging network software and application that can remotely manage the charging stations in the charging network, monitor their availability, serve all kinds of electric vehicles with socket structure, and receive payments from all electric vehicle users. During the evaluation of license applications, information and documents related to this software may be requested by our Institution.

Legal entities obtaining a license pursuant to the Regulation; Within one month at the latest after the license comes into effect, information about the geographical location of the charging stations, the number of charging units, their power and types, the number and types of sockets, their availability, payment method and charging service price. zammust establish a system that will present it to the Institution instantly, up-to-date, accurately and completely. A guide will be published on how to convey this information to our Institution, and it is important for the relevant parties to establish the necessary infrastructure and keep this structure operational before applying for a license.

Real or legal persons who want to operate the charging station on-site will be able to operate as a charging station operator by obtaining certificates from the license holders to be announced on the website of our Institution. In this respect, natural or legal persons who want to operate a charging station will be able to apply directly to the license holders and request a certificate without the need for a license, and they will be able to operate a charging station within the scope of the certificate they have obtained. Charging network operators will announce the procedures and principles regarding the rules they will apply in the issuance, termination and cancellation of certificates on the website.

Within the scope of the license application, it is obligatory for the relevant legal entities to submit the trademark registration certificate issued by the Turkish Patent and Trademark Office of the brand or brands to which they will provide charging service. For this reason, those concerned must first complete the trademark registration certificate process and then apply for a license.

Licensee legal entities are required to establish communication channels through which the complaints of electric vehicle users are forwarded, recorded and followed. In addition, legal entities that will apply for a license are required to establish a charging network that complies with the "interoperability" provisions of the Law and Regulation within the scope of charging service activity.

For those who want to have a license, the license fee is determined as 300.000 TL. This fee will be deposited into the relevant account announced on the website of our Institution by those concerned, and then the payment receipt will be uploaded to the system during the application. In the explanation part of the receipt, the title of the company that wants to obtain a license, its tax identification number and the expression "charge network operator license fee" should be stated. same zamAt the same time, the minimum capital required for legal entities to apply for a license has been determined as TL 4.500.000, and the documents showing the current capital amount of the legal entity must be uploaded to the system during the application.

Charging stations that currently offer charging services must be included in the charging network of a licensed charging network operator within 4 months (until 2.8.2022) from the date of entry into force of the Regulation, and those concerned must bring their status into compliance with the legislation in this context. At the end of this period, the “Irregular electricity use” provisions of the Electricity Market Consumer Services Regulation will be applied for the electricity subscriptions of the charging stations that are not connected to a charging network and that provide charging service, and the relevant network operator will notify the competent administration and the tax office. In addition, the sanctions specified in Article 16 of the Electricity Market Law will be applied to legal entities that do not obtain a license despite operating a charging network.
